Welcome to Melloa (the “Service”). The terms “we”, “us” and “our” refer to Melloa. We operate this website and store, including all information, content, features, products and services made available to you.

By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

1) Access & Account

  • You represent that you are at least the age of majority in your place of residence, or that you have parental consent.
  • You may be asked to provide accurate and complete information (e.g., email, billing, shipping). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You may not transfer or assign your account.

2) Products & Content

  • We aim to display products as accurately as possible; actual colors/appearance may vary by device settings.
  • Descriptions, images, pricing and availability may change without notice. We may limit quantities or discontinue items at any time.

3) Orders

  • Your order is an offer to buy; acceptance occurs only when we confirm dispatch/acceptance.
  • We may refuse, cancel or limit an order at our discretion (we will attempt to notify you using the contact details provided).
  • Orders are for personal/household use, not for resale.
  • Returns and cancellations are governed by our Refund Policy.

4) Prices, Taxes & Billing

  • Prices, promotions and shipping fees may change without notice. The price at checkout applies.
  • Unless stated otherwise, prices exclude taxes, duties, customs and import charges, which are your responsibility when applicable.
  • You agree to provide current, complete and accurate billing and payment information and authorize us to charge your payment method for the total due.

5) Shipping & Delivery

Shipping is governed by our Shipping Policy. Standard delivery usually takes 7–14 business days, subject to carrier/customs delays outside our control. Title and risk pass upon delivery to the carrier unless required otherwise by mandatory law.

6) Relationship with Shopify

Melloa is powered by Shopify. Sales are made directly by Melloa; Shopify is not a party to your transaction and is not responsible for our products or services.

7) Intellectual Property

All content on the Service (brands, text, images, graphics, design and arrangement) is owned by Melloa or our licensors and is protected by applicable laws. You may use the Service for personal, non-commercial purposes only. No license is granted except as expressly stated.

8) Third-Party Links & Optional Tools

Third-party tools and links are provided “as is” without warranties. Your use is at your own risk and subject to third-party terms.

9) Reviews & Feedback

If you submit reviews, ideas or other content (“Feedback”), you grant us a worldwide, sublicensable, royalty-free license to use and display such Feedback for operating, improving and promoting the Service. You represent you own or control the rights in your Feedback and that it complies with law and these Terms.

10) Prohibited Uses

You agree not to use the Service for unlawful, harmful, infringing, defamatory, deceptive, or abusive purposes; not to upload malicious code; not to scrape, spam or circumvent security; and not to infringe third-party rights. We may suspend or terminate access for violations.

11) Errors & Omissions

We may correct errors, inaccuracies or omissions (including pricing, availability and shipping information) and cancel orders affected by such errors, with notice where required by law.

12) Consumer Rights (UK & EU)

Nothing in these Terms affects your statutory rights, including under applicable consumer laws such as the UK Consumer Rights Act 2015 and EU consumer legislation (e.g., 14-day cooling-off for distance contracts as detailed in our Refund Policy).

13) Disclaimer of Warranties

Except as expressly stated by Melloa, the Service and all products are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

14) Limitation of Liability

To the fullest extent permitted by law, Melloa and our affiliates shall not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill arising from your use of the Service or products.

15) Indemnification

You agree to indemnify and hold harmless Melloa and our affiliates from claims arising out of your breach of these Terms or violation of law or third-party rights.

16) Privacy

Your personal information is processed in accordance with our Privacy Policy. As our store is hosted on Shopify, certain data is processed by Shopify to operate the Service.

17) Governing Law & Jurisdiction

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. The courts of Barcelona, Spain shall have exclusive jurisdiction, except where mandatory consumer laws provide otherwise.

18) Miscellaneous

  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • Waiver: Failure to enforce a right is not a waiver.
  • Assignment: You may not assign these Terms without our consent; we may assign without notice.
  • Entire Agreement: These Terms and policies referenced herein constitute the entire agreement regarding the Service.

19) Changes to These Terms

We may update these Terms from time to time. Material changes will be notified as required by law, and the effective date will be indicated. Your continued use of the Service after changes constitutes acceptance.
